What is Alimony?


Alimony is a financial arrangement paid by a male spouse to support a female spouse after the divorce on the court’s order. The concept of alimony is determined by our social patterns like “we believe that male is the main bread earner in the house and females are dependent on the male before marriage females are dependent on family and after marriage, females are dependent on the husband”. The last line is very controversial and contradicts the current generation because the female contribution to employment is growing and almost near to the male contribution in big cities. Still, our laws are drafted on social and historical beliefs. It’s also referred to as maintenance or spousal support. The final amount of alimony depends on various factors that we discussed later in this article.  


Types of Alimony in India


Under Indian law, alimony can be classified into two main types:

Temporary Alimony (Interim Maintenance):
Granted during divorce.
Meant to provide financial support to the dependent spouse until the final judgment is made.
Usually determined based on immediate financial needs and standard of living.


Permanent Alimony:
Granted after the divorce is finalized.
It can be provided as:
A lump sum payment (one-time settlement).
Regular periodic payments (monthly or annual basis).
In some cases, Child support payments are confused with alimony. Both are different. Child Support is for Children’s education and life needs, and Alimony is for spouses.

Legal Provisions Governing Alimony in India

Hindu Marriage Act, 1955 (Hindus, Sikhs, Jains, and Buddhists):

According to section 24 of the Hindu Marriage Act, 1955, the Husband and wife both can claim maintenance from their spouse but Indian courts mostly consider the wife as a dependent spouse so they are eligible to receive alimony from their ex-husband.
According to section 25 of the Hindu Marriage Act, 1995, the court can order the respondent to pay financial support to the dependent spouse. The amount of financial support depends on the couple’s income, property, life standard, and minimum needs.

Factors Considered in Deciding Alimony in India

Supreme Court of India has strictly conveyed to the lower courts to follow some mandatory factors to decide the alimony amount.


Financial Status:
One of the most important factors in deciding the alimony amount is the financial status of the couple

Duration of Marriage:
In most of, the cases court considered the duration of the marriage to decide the alimony, a shorter marriage term is the reason for the lesser alimony amount.

Standard of Living:
The court considered that the wife should have sufficient financial support to live the same standard of living as during the marriage.

Age and Health:
The court considered that older spouse deserves more alimony because they can’t earn an extra amount to live their lives.

Educational Background and Employability:
If the dependent spouse is capable of earning, the alimony amount may be lower.

Custody of Children:
If the female spouse gets custody of the children, then the wife gets a child support amount with an alimony amount.

Fault in Marriage (in some cases):
Courts may consider whether one spouse caused the breakdown of the marriage, though this is less common.

Future Prospects:
Anticipated future earnings or economic opportunities of both parties.

Can the Husband or respondent deny the payment of Alimony?

In India husband or respondent can’t deny the alimony or maintenance amount if they do, they have to face legal consequences like fines and Jail.


Is Alimony Taxable in India?

Lumpsum alimony is not taxable but the periodic monthly alimony will be considered as “ income from other spouse” and the receiver will have to pay the tax on it.

Conclusion

Alimony is a good beneficial system to support the depend but sometimes it can be manipulated by some people in some cases females are more capable and more earning than their husbands but although the husband has to pay the maintenance and alimony if wide claim in court. There is not any fixed formula to decide the alimony amount but in most of the cases court considers 25% of the husband’s income should be the alimony amount.
